MEDIATION FOR BUSINESSES, INDIVIDUALS AND ORGANISATIONS
Mediation is a process by which disputing parties are assisted by an independent third party to reach a resolution. It may be used by organizations, businesses, or private individuals.
For a mediation to be successful the parties must
- Act in good faith towards each other
- Genuinely want to achieve a settlement
It is cheaper and quicker than legal avenues such as litigation or arbitration. The lower cost of mediation is usually the driving force which encourages parties to reach a resolution, even though they may not always agree with the other party’s arguments or point of view.
Of course, sometimes the parties do not reach an agreement, but the mediation may have been useful in clarifying disputed issues. This is an advantage if the parties then go on to adopt other, more expensive modes of dispute resolution such as litigation or arbitration.
Any agreement reached at mediation can be made on a simple handshake, but it is advised that all agreements be put into writing and signed by all parties.
